John - Thank you again for your efforts in this case...Next time we won't rely on the dealer's word and make sure we have everything in writing that the vehicle has passed an inspection by a certified mechanic that no prior accident has occurred. It certainly is faulty logic to assume that the vehicle depreciation and sales price 4 years after the initial sale could be relevant to the original sales price. Basically we overpaid the [dealer] for the auto and he pocketed the overpayment...meanwhile we paid interest on that overpayment and then paid for an expert to examine the damage, pay for arbitration, pay for legal costs, and wait 4 years. It does seem that dealers are hiding behind the "Clean CarFax" report to exempt them from all liability for passing their own inspection, but as this case has proved if they don't get caught, then it is worth it. Perhaps you can enlighten them on another case down the road
